By accessing or using the Chaperone platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including borrowers, mortgage brokers, and lenders.
2. Description of Service
Chaperone is a digital mortgage application platform that connects borrowers with mortgage brokers and lenders in New Zealand. Our Service facilitates the mortgage application process but does not provide financial advice or make lending decisions.
Important: Chaperone is a technology platform and is not a lender, mortgage broker, or financial adviser. We do not guarantee approval of any mortgage application.
3. User Accounts
Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
4. User Responsibilities
By using the Service, you agree to:
- Provide accurate and truthful information in all applications and communications
- Not use the Service for any unlawful purpose
- Not attempt to gain unauthorised access to any part of the Service
- Not interfere with or disrupt the Service or servers
- Comply with all applicable New Zealand laws and regulations
5. Mortgage Applications
Application Process
When you submit a mortgage application through Chaperone, you authorise us to share your information with selected lenders and mortgage brokers for the purpose of processing your application.
No Guarantee
Submission of an application does not guarantee approval. All lending decisions are made by the respective lenders based on their own criteria and policies.
Accuracy of Information
You are solely responsible for the accuracy of the information you provide. Providing false or misleading information may result in rejection of your application and termination of your account.
6. Fees and Payments
Chaperone's core services for borrowers are currently free. We may introduce fees for certain services in the future, and we will notify you of any such changes in advance.
Any fees charged by lenders or mortgage brokers are separate from Chaperone and are governed by your agreements with those parties.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Chaperone and are protected by international copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Chaperone does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by New Zealand law, Chaperone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.
11. Indemnification
You agree to indemnify and hold harmless Chaperone and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Service and updating the "Last updated" date.
Your continued use of the Service after any changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
